DOLE: Employees must get 13th month

The Department of Labor and Employment announced that employers must give their workers their 13th month pay.


In an advisory issued by the department, deferment for the bonus is not allowed under Presidential Decree 851.


Department secretary Silvestre Bello also reminded employers to pay it no later than Dec. 24 this year.


The advisory in part said that the “minimum 13th month pay required by law shall not be less than one-twelfth of the total basic salary earned by an employee within a calendar year.”


It further stated that the “minimum amount shall be given without prejudice to existing company practice or policy, employment contract or collective bargaining agreement, if any.”


They must also be given 13th month pay “regardless of their position, designation or employment status, and irrespective of the method by which their wages are paid, as long as they have worked for at least one month during the calendar year.”
