Dismissed Cebu Customs District Collector Elvira Cruz should thank her lucky stars.
The Civil Service Commission (CSC), in a recent ruling penned by Chairman Alicia dela Rosa-Bala, ordered the reinstatement of Cruz because Customs lawyers failed to submit material evidence to further support their position that she should remain dismissed from her post.
The CSC earlier ordered the return of Cruz as Cebu district collector after finding Customs Commissioner Rey Guerrero’s memo placing her on floating status to be unwarranted and illegal.
In a motion for reconsideration, the Bureau of Customs said Cruz’s reassignment to the Port of Cebu monitoring unit for alleged gross negligence of duty was justified and did not violate her right to security of tenure.
The CSC took cognizance of the January 2020 decision of Executive Secretary Salvador Medialdea dismissing the administrative complaint against Cruz.
